commission agreement

Kiry's TOS

The following outlines the full terms that every client of mine agrees to when entering a commission agreement with me. Please read thoroughly and keep yourself informed - commissions are job contracts, not side hustles. This document is binding upon entering a commission agreement with me, and ignorance of its contents does not change or nullify the requirements it details.Last updated: Tuesday, 16th of July 2024, 12:04 PM EST

1. Payment and Pricing

1.1 Prices
All commissions are priced and payment is accepted in USD. The minimum price for any commission is $15, and prices are scaled to approximate a rate of $15/hr on average.
1.2 Payment Methods
Payments are accepted through Ko-fi via Stripe or directly through CashApp. PayPal may become an option in future.
1.3 Payment Schedule
First time customers must pay 100% upfront. Returning customers have the option to pay 50% upfront and 50% at the time of an approved sketch.
1.4 Refund Policy
A refund may be offered up to the end of the sketch stage at the artist's discretion. A refund will not be issued or only a partial refund will be issued based on various factors, including but not limited to: excessive change requests, harmful or derogatory behaviour, scam-like conduct, and attempts at art theft. A refund will never be issued after an approved sketch.
1.5 Additional Price Factors
Character illustrations will usually follow a fixed price structure for most human, humanoid, and anthropomorphic characters. Some more complex subjects, such as excessively complex outfits or mecha components/characters, may incur an increase in price that will be discussed on a case by case basis.
1.6 Original Characters
When a commission consists of the custom designing of a new character from scratch, the cost of the commission will incur +100% of the base price for the custom design process, and an extra +100% of the base price if the client desires an additional reference sheet for future use (e.g. a full body commission for one existing character is $60, custom designing a new character for this commission is $120, and including an additional reference sheet is $180).

2. Commission Options and Process

2.1 Adult Content
I accept NSFW commissions on a different price scale from SFW commissions. I do not accept commissions for gore.
2.2 Specializations and General Options
I specialize in figure drawing and character illustration, and accept commissions for character design, comic pages, logo design, infographics, and some other specialized design tasks.
2.3 Blacklisted Content
I do not accept commissions for anything that would violate common terms of service, including but not limited to depictions of sexual violence, minors or aged-up minors in sexual scenarios, violent crimes, or real-world people in sexual scenarios.
2.4 Commission Duration
Commissions may take longer or shorter depending on activity and backlog. Most commissions will be completed within 1-5 days of starting, but commissions may be held in a waitlist and will not necessarily be started immediately. The expected duration of a commission will always be made clear before starting, but any times provided are not binding and may fluctuate due to a variety of factors.
2.5 Updates
Updates will always be provided at the completion of each of the following stages: sketch (at which point approval is required to continue), lineart, colouring, shading, and post-processing (at which point the commission is complete). If any of the gaps between these set updates is longer than 24 hours, additional updates will be provided to bridge the gap.

3. Rights and Ownership

3.1 Reposting and Sharing
You are allowed to repost your commission on any platform that I do not post on as long as you credit me with a link/links. A link to my Ko-fi is not required but is appreciated. You should not repost your commission on any platform I have already posted it to, and instead share/retweet/reblog that post.
3.2 Commercial Rights
All commissions for commercial uses will cost double the price at minimum, and no commission may be used for commercial purposes until and unless this agreement has been made in writing and is reflected in the payment. Some commercial uses may require further discussion regarding a further price increase or a revenue sharing agreement, such as the use of commissioned artwork in film or video games.
3.3 Resale and Reuse
No form of direct resale is ever allowed. You are not allowed to use your commission for direct resale on merchandise, nor use them for any similar purpose. As previously stated in 3.2, commissions may be used as components of larger works such as film or video games, so long as commercial rights have been agreed upon.
3.4 Artist's Rights
I retain the copyright to my artwork regardless of its agreed-upon purpose or its status as a commissioned piece. My artwork may only be used for purposes I have explicitly allowed in writing, in this document and/or in the commission agreement in question. Permission will never be given for my art to be used for any purpose related to AI training, NFTs, or the direct promotion/facilitation of any cryptocurrency.
